Terms & Conditions
These terms govern the use of our website and the basis on which Kinabalu Advocates provides legal services to clients.
1. Introduction
These Terms and Conditions apply to the website operated by Kinabalu Advocates at kinabalu.live and to the legal services we provide. By accessing our website or submitting a consultation request, you acknowledge that you have read and understood these terms.
Kinabalu Advocates is a legal practice comprising advocates and solicitors admitted to practice in Sabah, Malaysia. Our principal office is at Level 9, Wisma Sabah, Jalan Tun Razak, 88000 Kota Kinabalu, Sabah.
2. Website Use
The content on our website is provided for general informational purposes. It does not constitute legal advice and should not be relied upon as such. Each legal matter involves its own specific facts, and the information on this website cannot substitute for advice tailored to your circumstances.
You may access and read the content of this website for personal, non-commercial purposes. You must not reproduce, distribute, or republish any portion of this website without our prior written consent.
We reserve the right to modify or withdraw any part of this website at any time without notice.
3. No Solicitor-Client Relationship
Submitting a consultation request through our website, sending us an email, or calling our office does not, by itself, create a solicitor-client relationship. A formal relationship is only established when we have confirmed in writing that we are acting for you in a specific matter and the applicable terms of engagement have been agreed.
Until such a relationship is established, any information you share with us is not protected by solicitor-client privilege, though we will treat it with appropriate discretion.
4. Our Services
Kinabalu Advocates provides legal services in the following areas, among others:
- Land and native title matters in Sabah
- Small business and sole proprietor advisory
- Tenancy and lease disputes
The scope of any specific engagement, including fees, deliverables, and timelines, will be confirmed separately in a letter of engagement or client agreement prior to commencement of substantive work. Published service descriptions and pricing on our website are indicative and may vary depending on the specific circumstances of your matter.
5. Fees and Billing
Fees for our legal services are discussed with clients prior to engagement and set out in our letter of engagement. Where published prices are shown on our website, these represent indicative starting points and the final fee will depend on the nature and complexity of your matter.
Our practice is regulated and our fee arrangements are subject to the requirements of the Legal Profession Ordinance (Sabah Cap. 2) and subsidiary legislation governing solicitors' charges in Sabah and Sarawak.
Disbursements — including court filing fees, stamp duty, land search fees, and similar third-party charges — are payable by clients in addition to professional fees unless otherwise agreed.
6. Client Obligations
Where we have agreed to act for you, we rely on you to provide accurate and complete information relevant to your matter. If the information you provide changes, you are responsible for informing us promptly. Decisions made on the basis of incomplete or inaccurate information may affect the outcome of your matter and the applicability of our advice.
You agree to respond to our reasonable requests for instructions and documents in a timely manner so that we may act effectively on your behalf.
7. Limitation of Liability
To the extent permitted by law, Kinabalu Advocates' liability in connection with the provision of legal services is subject to the terms agreed in the applicable letter of engagement. Our liability does not extend to losses that were not foreseeable at the time the engagement was entered into, or to losses arising from reliance on information provided to us that was inaccurate or incomplete.
The content of this website is provided without warranty of any kind. We do not accept liability for any loss or inconvenience arising from your use of, or reliance on, the general information published here.
8. Third-Party Links
Our website may contain links to third-party websites for your convenience. These links do not imply endorsement of those sites and we are not responsible for their content or privacy practices. You access third-party sites at your own risk.
9. Intellectual Property
All content on this website, including text, design, and layout, is the property of Kinabalu Advocates unless otherwise noted. You are welcome to read and refer to this content for personal use but may not reproduce it for commercial purposes without our consent.
10. Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from your use of this website or from the provision of our legal services shall be subject to the jurisdiction of the courts of Malaysia, with Kota Kinabalu as the primary venue unless otherwise agreed.
